Surplus Screensaver END-USER LICENSE AGREEMENT

Please read this document carefully before proceeding.

This agreement licenses software to you and contains warranty disclaimers.

Definitions
------------
(a) "Surplus" means the software program covered by this Agreement.
(b) "Surplus Product" means the screen saver software and related documentation, models and multimedia content.

License
-------
This agreement allows you to:
(a) Use the Surplus Product on a single computer.
(b) Make one copy of the Surplus Product in machine-readable form solely for backup purposes.
You must reproduce on any such copy all copyright notices and any other proprietary legends found on the original.

Restrictions
------------
You must be 21 years or older to use the Surplus Product.
You may not make or distribute copies of the Surplus Product or electronically transfer the Surplus Product from one computer to another or over a network.
You may not decompile, reverse engineer, disassemble, or otherwise reduce the Surplus Product to a human perceivable form.
You may not modify, rent, resell for profit, distribute or create derivative works based upon the Surplus Product into any country prohibited by the United States Export Administration Act and the regulations thereunder.

Ownership
---------
The foregoing license gives you limited rights to use the Surplus Product.
You do not become the owner of, and Kay Rosen retains title to the Surplus Product, and all copies thereof.
All rights not specifically granted in this Agreement, including Federal and International Copyrights, are reserved by Kay Rosen.

Disclaimer of Warranties and of Technical Support

The Surplus Product is provided to you free of charge, and on an "AS IS" basis,
without any technical support or warranty of any kind from R.J. Reynolds Tobacco Company including, without limitation, a warranty of merchantability,
fitness for a particular purpose and non-infringement.

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.

These limitations or exclusions of warranties and liability do not affect or prejudice the statutory rights of a consumer, i.e., a person acquiring goods otherwise than in the course of a business.

Limitation of Damages

R.J. REYNOLDS TOBACCO COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE),
WHETHER BASED ON BREACH OF CONTRACT , TORT, (INCLUDING NEGLIGENCE),PRODUCT LIABILITY OR OTHERWISE, EVEN IF R.J. REYNOLDS TOBACCO COMPANY OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

The limited warranty, exclusive remedies and limited liability set forth above are fundamental elements of the basis of the bargain between R.J. Reynolds Tobacco Company and you.
You agree the R.J. Reynolds Tobacco Company would not be able to provide the Surplus Software on an economic basis without such limitations.

General
-------
This agreement shall be governed by the internal laws of the State of North Carolina.
This Agreement contains the complete agreement between parties with the respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings whether oral or written.

Mac:
Mac (680X0 processor or better) and Power PC
Compatible with system 7.x - preferably 7.1 or higher
2.5 Meg free hard drive disc space
8 Meg RAM

Installation Instructions
-------------------------
PC Version
1. Locate the installer named "install.exe" (on your desktop or in the folder you have just extracted to). You will also find a "readme.txt" file that explains the terms and conditions of use. Double click "install.exe" to install the Sur+Plus Screen Saver.
2. Once installed, you may modify the Sur+Plus Screen Saver by selecting the "Display" settings in your control panel.

Mac Version
1. Locate the Surplus icon on your desktop and double click it.
2. This opens a folder with the screen saver installer named "surplus" and a "readme" file that explains the terms and conditions of use.
3. Double click the "surplus" icon and follow the installation instructions.
4. Save the Sur+Plus Screen Saver to your hard drive at the prompt, and then restart your computer once the install is complete.
5. Once installed, you may modify the Sur+Plus Screen Saver by selecting the "Sur+Plus" in your control panel.
6. If you are unable to install over your existing screen saver, drag the existing screen saver from your control panel folder to your disabled control panel. This will disable your old screen saver and allow activation of the Sur+Plus Screen Saver
